Purpose of this Policy<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This Policy governs the protection and use of content, distinctive signs, creative materials, catalogues, business information and, more generally, intellectual property rights appearing on <a href=\"http:\/\/www.perlepietre.com\/\">www.perlepietre.com<\/a> and in digital and commercial materials associated with <strong>Perlepietre S.r.l.<\/strong> (&#8220;Perlepietre&#8221; or the &#8220;Company&#8221;).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perlepietre operates in the B2B jewellery industry, dealing in semi-precious stones, pearls, coral, cameos, amber, silver and metal components, semi-finished products and related accessories, serving professional customers in Italy, the European Union and worldwide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This Policy is intended to:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>protect Perlepietre&#8217;s intellectual property rights;<\/li>\n\n\n\n<li>clarify which uses of the website content are permitted and which are prohibited;<\/li>\n\n\n\n<li>regulate the use of product images and product-related information;<\/li>\n\n\n\n<li>protect content belonging to partners, suppliers or other rights holders;<\/li>\n\n\n\n<li>prevent systematic copying of the catalogue, scraping, duplication of product listings and unauthorised commercial use;<\/li>\n\n\n\n<li>establish a procedure for reporting potential infringements;<\/li>\n\n\n\n<li>provide a framework applicable also to users and customers located outside Italy.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-2-scope-of-application\" class=\"wp-block-heading\">2. Scope of Application<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This Policy applies, by way of example and without limitation, to all content published or made available through:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"http:\/\/www.perlepietre.com\/\">www.perlepietre.com<\/a>;<\/li>\n\n\n\n<li>any language versions of the website;<\/li>\n\n\n\n<li>product pages;<\/li>\n\n\n\n<li>categories and subcategories;<\/li>\n\n\n\n<li>images and photographs;<\/li>\n\n\n\n<li>digital catalogues;<\/li>\n\n\n\n<li>product listings;<\/li>\n\n\n\n<li>descriptions;<\/li>\n\n\n\n<li>editorial content;<\/li>\n\n\n\n<li>articles and blog content;<\/li>\n\n\n\n<li>newsletters;<\/li>\n\n\n\n<li>commercial materials;<\/li>\n\n\n\n<li>images and videos;<\/li>\n\n\n\n<li>graphic elements;<\/li>\n\n\n\n<li>logos and trademarks;<\/li>\n\n\n\n<li>databases and catalogues;<\/li>\n\n\n\n<li>technical and commercial documentation;<\/li>\n\n\n\n<li>content published on the Company&#8217;s official social media channels;<\/li>\n\n\n\n<li>materials provided directly to customers;<\/li>\n\n\n\n<li>any systems, tools or digital interfaces made available by the Company.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This Policy applies regardless of the device used to access the content and regardless of the country from which the user accesses the website.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-3-ownership-and-rights-in-the-content\" class=\"wp-block-heading\">3. Protected Content<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The website <a href=\"http:\/\/www.perlepietre.com\/\">www.perlepietre.com<\/a> contains numerous elements that may be protected under Italian, European and international intellectual property laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By way of example, protected content may include:<\/p>\n\n\n\n<h3 id=\"h-4-1-text\" class=\"wp-block-heading\">4.1 Text<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>product descriptions;<\/li>\n\n\n\n<li>page content;<\/li>\n\n\n\n<li>category content;<\/li>\n\n\n\n<li>blog content;<\/li>\n\n\n\n<li>guides;<\/li>\n\n\n\n<li>articles;<\/li>\n\n\n\n<li>informational content;<\/li>\n\n\n\n<li>commercial copy;<\/li>\n\n\n\n<li>communications;<\/li>\n\n\n\n<li>FAQs;<\/li>\n\n\n\n<li>technical content;<\/li>\n\n\n\n<li>original translations;<\/li>\n\n\n\n<li>any original slogans or claims.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Protection does not depend on the presence of the \u00a9 symbol.<\/p>\n\n\n\n<h3 id=\"h-4-2-photographs-and-images\" class=\"wp-block-heading\">4.2 Photographs and Images<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>product photographs;<\/li>\n\n\n\n<li>lifestyle photographs;<\/li>\n\n\n\n<li>corporate photographs;<\/li>\n\n\n\n<li>jewellery photographs;<\/li>\n\n\n\n<li>images of stones, pearls, coral, cameos and other materials;<\/li>\n\n\n\n<li>images used in categories;<\/li>\n\n\n\n<li>images used in commercial campaigns;<\/li>\n\n\n\n<li>banners;<\/li>\n\n\n\n<li>editorial images;<\/li>\n\n\n\n<li>photographs of individuals, where applicable;<\/li>\n\n\n\n<li>photographs created for Perlepietre by photographers or agencies.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Photographs may be protected by copyright and\/or related rights under applicable law. The mere availability of a photograph on the website does not grant the public any right to copy, download, modify or commercially exploit it.<\/p>\n\n\n\n<h3 id=\"h-4-3-product-listings-and-descriptions\" class=\"wp-block-heading\">4.3 Product Listings and Descriptions<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Product listings may comprise a combination of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>photographs;<\/li>\n\n\n\n<li>text;<\/li>\n\n\n\n<li>specifications;<\/li>\n\n\n\n<li>measurements;<\/li>\n\n\n\n<li>names and designations;<\/li>\n\n\n\n<li>product codes;<\/li>\n\n\n\n<li>technical information;<\/li>\n\n\n\n<li>variants;<\/li>\n\n\n\n<li>classifications;<\/li>\n\n\n\n<li>graphic layout;<\/li>\n\n\n\n<li>commercial information.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Any original and creative elements contained in product listings may be protected by copyright. In addition, the systematic organisation of information and the investment made in creating and maintaining a catalogue may, where the statutory requirements are met, qualify for the protection afforded to databases.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-5-catalogue-structure-and-database\" class=\"wp-block-heading\">5. Catalogue, Structure and Database<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Perlepietre&#8217;s catalogue constitutes an organised collection of commercial and technical information relating to thousands of products.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The following activities are therefore prohibited without the Company&#8217;s prior written authorisation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>systematic copying of the catalogue;<\/li>\n\n\n\n<li>bulk extraction of data;<\/li>\n\n\n\n<li>automated downloading of product listings;<\/li>\n\n\n\n<li>scraping of the website;<\/li>\n\n\n\n<li>automated collection of images;<\/li>\n\n\n\n<li>systematic copying of prices;<\/li>\n\n\n\n<li>systematic copying of product codes;<\/li>\n\n\n\n<li>reproducing the catalogue on third-party websites;<\/li>\n\n\n\n<li>automated import of data into marketplaces or other e-commerce platforms;<\/li>\n\n\n\n<li>mass republication of product listings;<\/li>\n\n\n\n<li>creating competing databases through the systematic extraction of website content.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Uses permitted by law remain unaffected.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-6-trademarks-trade-name-and-distinctive-signs\" class=\"wp-block-heading\">6. Trademarks, Trade Name and Distinctive Signs<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The name &#8220;Perlepietre&#8221;, its logo, distinctive signs, trade names, registered and unregistered trademarks, and any other identifying elements of the Company may not be used by third parties in a manner that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>creates confusion as to the origin of products or services;<\/li>\n\n\n\n<li>suggests that a third party is affiliated with, authorised by or otherwise connected to Perlepietre;<\/li>\n\n\n\n<li>implies sponsorship or endorsement by the Company;<\/li>\n\n\n\n<li>creates an unauthorised commercial association;<\/li>\n\n\n\n<li>damages the Company&#8217;s reputation;<\/li>\n\n\n\n<li>is used in misleading advertising;<\/li>\n\n\n\n<li>is incorporated into domains, accounts, pages or profiles likely to cause confusion.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A reference by name to Perlepietre as the supplier of products actually purchased is permitted where necessary to accurately describe the commercial relationship, provided that no false relationship of authorisation, agency or representation is created.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-7-jewellery-product-models-and-designs\" class=\"wp-block-heading\">7. Jewellery, Product Models and Designs<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The sale of a physical product does not automatically transfer to the purchaser any intellectual property rights that may exist in the product&#8217;s design, model, drawings, photographs, content or creative elements associated with the product.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where applicable, certain jewellery items, models or ornamental elements may be protected by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>copyright;<\/li>\n\n\n\n<li>registered designs;<\/li>\n\n\n\n<li>unregistered designs;<\/li>\n\n\n\n<li>trademarks;<\/li>\n\n\n\n<li>unfair competition laws;<\/li>\n\n\n\n<li>other forms of industrial or intellectual property protection.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The scope of protection depends on ownership of the relevant right, the characteristics of the individual product, its originality and any registrations that may exist. This Policy does not constitute a representation that every individual product marketed by Perlepietre is independently protected by an intellectual property right.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-8-materials-belonging-to-suppliers-partners-and-third-parties\" class=\"wp-block-heading\">8. Materials Belonging to Suppliers, Partners and Third Parties<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Certain content appearing on the website may be supplied by manufacturers, suppliers, business partners, photographers, agencies, contractors or other parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such content remains subject to the rights of the respective rights holders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perlepietre may have the right to use such content on its website and through its commercial channels without this necessarily resulting in a transfer of ownership of the relevant rights to the Company. Users and customers may therefore not assume that the presence of content on the website constitutes a general licence to reuse it.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-9-prohibition-on-copying-photographs\" class=\"wp-block-heading\">9. Prohibition on Copying Photographs<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Unless expressly authorised by the Company or otherwise permitted by law, it is prohibited to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>copy photographs appearing on the website;<\/li>\n\n\n\n<li>download them for use on other websites;<\/li>\n\n\n\n<li>publish them on marketplaces;<\/li>\n\n\n\n<li>use them on any marketplace, social network or other commercial platform;<\/li>\n\n\n\n<li>include them in third-party catalogues;<\/li>\n\n\n\n<li>use them in advertising campaigns;<\/li>\n\n\n\n<li>modify and republish them;<\/li>\n\n\n\n<li>remove watermarks, logos or other identifying elements;<\/li>\n\n\n\n<li>use automated tools to systematically acquire images.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This prohibition applies even where an image is technically downloadable through a web browser.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-10-use-by-b2b-customers\" class=\"wp-block-heading\">10. Use by B2B Customers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The purchase of products from Perlepietre does not automatically grant the purchaser the right to use photographs, text, product listings or other website content for the marketing or sale of the purchased products.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where Perlepietre expressly makes photographs, descriptions, catalogues or other materials available to a customer for commercial purposes, the relevant authorisation shall be governed by the terms communicated by the Company.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the absence of specific terms, any authorisation to use such materials shall be deemed:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>non-exclusive;<\/li>\n\n\n\n<li>limited to the authorised purposes;<\/li>\n\n\n\n<li>non-transferable to third parties;<\/li>\n\n\n\n<li>not to involve any transfer of intellectual property rights;<\/li>\n\n\n\n<li>revocable where permitted under the applicable agreement.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The authorisation may be conditional upon the continuation of the commercial relationship with Perlepietre and\/or the marketing of products actually purchased from the Company.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-11-authorised-use-of-images-by-resellers\" class=\"wp-block-heading\">11. Authorised Use of Images by Resellers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Where Perlepietre authorises a professional customer to use product photographs and descriptions, such use shall be limited to the promotion and sale of the Perlepietre products to which the relevant materials relate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unless otherwise agreed in writing, the customer is not authorised to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sell or license the photographs to third parties;<\/li>\n\n\n\n<li>create image databases;<\/li>\n\n\n\n<li>distribute the images to parties outside its own sales process;<\/li>\n\n\n\n<li>use the photographs for different products;<\/li>\n\n\n\n<li>modify the content in a manner that alters its characteristics or meaning;<\/li>\n\n\n\n<li>remove ownership notices;<\/li>\n\n\n\n<li>use the materials after the authorisation has expired or been terminated;<\/li>\n\n\n\n<li>present the photographs as the customer&#8217;s own original works.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Company may establish different conditions through commercial agreements, media kits, catalogues or specific authorisations.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-12-links-to-the-website\" class=\"wp-block-heading\">12. Links to the Website<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It is generally permitted to create hyperlinks to publicly accessible pages of the website provided that the link:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>actually leads to the Perlepietre website;<\/li>\n\n\n\n<li>does not alter the content of the linked page;<\/li>\n\n\n\n<li>does not create confusion as to the identity of the website operator;<\/li>\n\n\n\n<li>does not suggest non-existent commercial relationships;<\/li>\n\n\n\n<li>is not used for unlawful purposes.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The following are prohibited without written authorisation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>framing techniques that incorporate Perlepietre&#8217;s pages within third-party websites;<\/li>\n\n\n\n<li>in-line linking techniques used to make Perlepietre content appear as third-party content;<\/li>\n\n\n\n<li>copies or replicas of website pages;<\/li>\n\n\n\n<li>uses that may create confusion as to the origin of the content.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Company may request the removal of links or embedding methods that infringe or otherwise adversely affect its rights.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-13-scraping-crawling-and-automated-systems\" class=\"wp-block-heading\">13. Scraping, Crawling and Automated Systems<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It is prohibited to use bots, crawlers, scrapers, software, scripts, browser extensions, automated systems or other technological means to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>systematically copy the catalogue;<\/li>\n\n\n\n<li>extract images;<\/li>\n\n\n\n<li>collect descriptions;<\/li>\n\n\n\n<li>collect prices;<\/li>\n\n\n\n<li>extract product codes;<\/li>\n\n\n\n<li>reconstruct the product database;<\/li>\n\n\n\n<li>systematically monitor the catalogue;<\/li>\n\n\n\n<li>duplicate website pages;<\/li>\n\n\n\n<li>populate databases, marketplaces or competing websites.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The following remain unaffected:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>technical access necessary for the normal operation of the Internet;<\/li>\n\n\n\n<li>search engines operating lawfully and in accordance with their intended purposes;<\/li>\n\n\n\n<li>uses permitted by law;<\/li>\n\n\n\n<li>any written authorisation granted by the Company.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Perlepietre reserves the right to implement proportionate technical measures to prevent or restrict unauthorised automated access.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-14-search-engine-indexing\" class=\"wp-block-heading\">14. Search Engine Indexing<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of a Perlepietre page in the results of a search engine does not grant the search engine or its users any ownership rights over the indexed content.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The technical indexing of a page does not constitute authorisation to reproduce its content in full on third-party websites.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perlepietre may implement technical measures to regulate access to and indexing of its content, in accordance with applicable law.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-15-blog-and-editorial-content\" class=\"wp-block-heading\">15. Blog and Editorial Content<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Articles, guides, informational texts and other editorial content published by Perlepietre may be protected by copyright.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Short extracts may be quoted within the limits permitted by law, provided that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the quotation is justified by the purpose for which it is used;<\/li>\n\n\n\n<li>the source is identified;<\/li>\n\n\n\n<li>no substantial portion of the work is reproduced;<\/li>\n\n\n\n<li>the quotation is not presented as the user&#8217;s original content;<\/li>\n\n\n\n<li>the rights of the Company or third parties are not infringed.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Full or substantial reproduction of articles, including where only minor modifications have been made, requires authorisation unless otherwise permitted by law.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-16-translations-and-derivative-content\" class=\"wp-block-heading\">16.
